The Delhi government on Monday, February 2, informed the Supreme Court that it will not implement the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025 for the 2025-26 academic year. The law, which aims to regulate fees charged by private schools in Delhi, will now come into effect from the 2026-27 academic session, the Rekha Gupta-led government said. The top court was hearing a batch of petitions filed by private school associations. The petition challenged the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025, in the Delhi High Court.
A Bench led by Justice PS Narasimha welcomed the submission by Additional Solicitor General S.V. Raju, representing the Delhi government’s Director of Education, that “it seems better sense has prevailed finally.” Earlier this week, the Supreme Court had given the Delhi government an additional week to decide whether to defer the implementation of the private school fee regulation law for the 2025-26 academic year. During the hearing, the Bench had raised concerns over the “rushed implementation” of the 2025 Act by the government.
Delhi School Education Act
The School Fee Regulation Bill, 2025, was passed by the Delhi Assembly in August, 2025. This Act gives veto power to parents in decisions regarding fee hikes, ensuring that school managements cannot unilaterally impose fee increases. According to the provisions, schools found arbitrarily hiking fees could face penalties and even losing their right to propose fee revisions in the future. The Act lays out that if a school charges fees beyond the permitted limit, it must refund the excess amount within 20 working days.
